By accessing olsenglassdesigns.com (the "Site") or placing an order through the Site, you agree to these Terms & Conditions (the "Terms"). Please review them carefully. Continued use of the Site constitutes acceptance of the Terms in their then-current form.
1. The Parties
The Site is operated by Olsen Glass Designs LLC, a Connecticut limited liability company. References herein to "Olsen Glass Designs," "we," "us," or "our" refer to Olsen Glass Designs LLC. References to "you" or "your" refer to any visitor or customer of the Site.

2. Sales Channels
Olsen Glass Designs pieces are made available through the following channels:

olsenglassdesigns.com — timed drops and standing inventory (governed by these Terms)

Whatnot live sales — governed by Whatnot's terms and policies

Authorized retail and brick-and-mortar partners — governed by the retailer's terms
These Terms apply only to purchases made directly through olsenglassdesigns.com. Pieces obtained through other channels are subject to the terms of the seller from whom they were obtained.
3. Drops and Standing Inventory
Selected pieces are released through limited drops. Each drop is offered in finite quantity; once a drop is sold out, the listing is closed. No waitlist or backorder is available unless expressly announced.
Standing inventory is offered in addition to drops and is subject to the same Terms.
4. Per-Customer Purchase Limits
To preserve fair access during drops, the Site enforces per-customer purchase limits — typically one piece per color and one Full Clutch per drop window. These limits are enforced automatically through customer email, billing address, and payment card. Orders that exceed an applicable limit will be canceled by the system and refunded through Wix Payments without manual review.
5. Pricing and Availability
All prices are listed in U.S. Dollars. Olsen Glass Designs reserves the right to correct pricing errors and to modify prices at any time without prior notice. In the event a pricing error is identified after an order has been placed, we will contact the customer to confirm or cancel the order before processing payment.
6. Order Acceptance
The placement of an order constitutes an offer to purchase, which is accepted upon confirmation by email and successful charge of the customer's payment method. Olsen Glass Designs reserves the right to decline or cancel any order at its discretion, including in cases of suspected fraud, attempted resale, or violation of these Terms. Refunds for canceled orders are processed through Wix Payments to the original method of payment.
7. Payment
Olsen Glass Designs accepts the following payment methods: major credit and debit cards (processed through Wix Payments), Apple Pay, and PayPal. All payment information is handled by the applicable processor and is not stored on Olsen Glass Designs systems in unencrypted form. By submitting an order, the customer confirms that the payment method provided is authorized and is the customer's own.
8. Shipping, Returns, and Damage Claims
Shipping terms, lead times, and the procedure for filing damage claims are set forth in the Site's Shipping Policy and Return & Refund Policy, each of which is incorporated by reference into these Terms.
9. Intellectual Property
All content displayed on the Site — including but not limited to product photographs, illustrations, written descriptions, the Olsen Glass Designs name, logo, and product designs — is the property of Olsen Glass Designs LLC and is protected under United States and international copyright, trademark, and related laws.
Customers may not, without prior written authorization:

Reproduce, distribute, or commercially exploit any product photographs or content from the Site

Use the Olsen Glass Designs name or logo in any manner that implies endorsement, sponsorship, or affiliation

Resell pieces in a manner that misrepresents their origin or association with Olsen Glass Designs
Purchase of a piece conveys ownership of the physical object only, and does not transfer rights in the underlying designs, photographs, or trademarks.
10. User Conduct
By using the Site, you agree not to:

Use the Site for any unlawful purpose

Circumvent or attempt to circumvent anti-bot measures (including reCAPTCHA), per-customer purchase limits, or cart reservation systems

Use automated tools, including bots, scrapers, or scripts, to place orders, monitor inventory, or extract pricing data

Resell Olsen Glass Designs pieces in a manner that violates applicable law or misrepresents the origin of the goods

Submit false, fraudulent, or misleading payment, contact, or shipping information
Olsen Glass Designs reserves the right to suspend accounts, cancel orders, and pursue legal remedies for violations of these provisions.
11. Warranty Disclaimer
THE SITE AND ALL PIECES PURCHASED THROUGH THE SITE ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OLSEN GLASS DESIGNS LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Olsen Glass Designs LLC makes no warranty regarding the accuracy, completeness, uninterrupted availability, or virus-free operation of the Site, or that any piece will meet your particular requirements or expectations.
Glass is a natural medium. Minor variations in color, shape, and finish between individual pieces are characteristic of the medium and do not constitute defects.
12. Limitation of Liability
To the fullest extent permitted by applicable law, the total liability of Olsen Glass Designs LLC arising out of or related to your use of the Site or purchase of a piece is limited to the amount paid by the customer for the piece in question. Olsen Glass Designs LLC shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost data, personal injury, property damage, or loss of goodwill, even if Olsen Glass Designs LLC has been advised of the possibility of such damages.
Where applicable law does not permit certain limitations of liability, the limitations set forth in this section apply only to the extent permitted by such law.
13. Product Use; Adult Collectible; Not a Toy
Olsen Glass Designs pieces are decorative collectibles intended for adult use and display only. They are not toys and are not designed, manufactured, or intended for use by or around children.
By purchasing a piece, the customer acknowledges and agrees that:

Pieces are intended for collectors aged fourteen (14) and older

Pieces are not safe for use by infants, toddlers, or young children, and may present a choking, cutting, or laceration hazard if broken or mishandled

Pieces should be displayed out of the reach of children and pets

Pieces are not food-safe and not for food or beverage contact unless expressly labeled otherwise
-
Pieces should not be subjected to thermal shock, direct flame, microwave, dishwasher, or freezer use
Improper use of a piece — including any use inconsistent with its character as a decorative collectible — voids any warranty (to the extent any exists) and releases Olsen Glass Designs LLC from any liability arising from such use.
14. Lead Content; California Proposition 65 Warning
⚠ WARNING: Pieces sold by Olsen Glass Designs may contain lead and other substances known to the State of California to cause cancer, birth defects, or other reproductive harm. For more information, visit www.P65Warnings.ca.gov.
Pieces should be handled with clean hands, should not be placed in the mouth, and should not be used to hold food or beverages. The customer assumes all risk associated with handling, displaying, and using pieces with knowledge of this disclosure.
15. Assumption of Risk
Glass is inherently fragile. By purchasing a piece, the customer assumes all risk associated with the handling, transport (after delivery), display, and possession of fragile glass, including the risk of breakage and any resulting injury or property damage. Olsen Glass Designs LLC shall not be liable for personal injury, cuts, lacerations, allergic reactions, or property damage arising from a piece in the customer's possession, including damage caused by a piece that has broken, fallen, been dropped, or otherwise been mishandled.
16. Mandatory Binding Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO RESOLVE DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT, AND IT WAIVES YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.
16.1 Agreement to Arbitrate
You and Olsen Glass Designs LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, any product purchased from the Site, or the relationship between you and Olsen Glass Designs LLC (each, a "Dispute") shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, rather than in court, except as set forth in Section 16.4 below.
This Section 16 evidences a transaction in interstate commerce, and the Federal Arbitration Act, 9 U.S.C. § 1 et seq., governs the interpretation and enforcement of this Section 16.
16.2 Class Action Waiver
YOU AND OLSEN GLASS DESIGNS LLC AGREE TO BRING ANY DISPUTE IN ARBITRATION ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A PLAINTIFF, CLASS REPRESENTATIVE, OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative proceeding.
If a court determines that this Section 16.2 is unenforceable as to a particular Dispute, then the entirety of Section 16 shall be null and void as to that Dispute, and the parties shall litigate that Dispute exclusively in the courts identified in Section 17.
16.3 Arbitration Procedures
Arbitration shall be conducted by a single neutral arbitrator selected in accordance with AAA's Consumer Arbitration Rules. Arbitration shall be conducted in writing or by telephone or video conference unless AAA's rules require an in-person hearing; any in-person hearing shall be held in Hartford County, Connecticut, or another location mutually agreed upon by the parties.
Olsen Glass Designs LLC will pay all AAA filing, administrative, and arbitrator fees for any Dispute in which the customer seeks less than ten thousand dollars ($10,000), unless the arbitrator determines that the customer's claim is frivolous or brought for an improper purpose, in which case the allocation of fees shall be governed by AAA's rules. For Disputes in which the customer seeks ten thousand dollars ($10,000) or more, fees shall be allocated in accordance with AAA's Consumer Arbitration Rules.
The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
16.4 Exceptions
Notwithstanding Section 16.1, the following types of claims are excluded from mandatory arbitration:

Claims qualifying for and brought in small claims court, provided the claim remains in small claims court and is brought on an individual (non-representative, non-class) basis

Claims by Olsen Glass Designs LLC for injunctive or other equitable relief to prevent or stop infringement, misappropriation, or unauthorized use of its intellectual property
-
Any other claim that applicable law renders non-arbitrable

16.5 Right to Opt Out
You may opt out of this Section 16 by sending written notice to Olsen Glass Designs LLC at amanda@olsenglassdesigns.com within thirty (30) days of the date you first accept these Terms. Your opt-out notice must include your full name, mailing address, the email address used to make any account or purchase on the Site, and a clear statement that you wish to opt out of the arbitration agreement in Section 16. Opting out will not affect any other portion of these Terms.
16.6 Severability
If any portion of this Section 16 (other than Section 16.2) is found to be invalid or unenforceable, the remaining portions of this Section 16 shall remain in full force and effect.
17. Governing Law and Venue for Non-Arbitrable Matters
These Terms are governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict-of-law principles.
For any matter not subject to mandatory arbitration under Section 16 — including, without limitation, the matters identified in Section 16.4 — the parties consent to the exclusive jurisdiction of the state and federal courts located in Hartford County, Connecticut, and waive any objection to venue in those courts.
Prior to commencing any legal action or arbitration, the customer is encouraged to contact Olsen Glass Designs at amanda@olsenglassdesigns.com to seek informal resolution.
18. Modifications to These Terms
Olsen Glass Designs LLC reserves the right to modify these Terms at any time. Material changes will be reflected by an updated "Last updated" date at the top of this document. Continued use of the Site following any modification constitutes acceptance of the revised Terms.
